CONCEPTUALIZACIÓN
La protección de tus datos personales es un derecho vinculado a la protección de tu privacidad. Te ofrece los medios para controlar el uso ajeno y destino de tu información personal, con el propósito de impedir su tráfico ilícito y la potencial vulneración de la dignidad humana.
Este poder de control sobre los datos personales se manifiesta a través de los denominados derechos ARCO (Acceso, Rectificación, Cancelación y Oposición), a través de los cuales se tiene la facultad de:
- Conocer en todo momento quién dispone de sus datos y para qué están siendo utilizados.
- Solicitar rectificación de sus datos en caso de que resulten incompletos o inexactos.
- Solicitar la cancelación de los mismos por no ajustarse a las disposiciones aplicables.
- Oponerse al uso de sus datos si es que los mismos fueron obtenidos sin su consentimiento.
A efecto de garantizar la debida protección de tus datos personales, además de establecer los derechos ARCO, la ley en la materia incluye una serie de principios rectores en el tratamiento de este tipo de datos como son: el de calidad, confidencialidad, consentimiento, finalidad, información, lealtad, licitud, proporcionalidad, transparencia y temporalidad. El incumplimiento de estos principios por parte de quienes detentan y/o administran tus datos constituye una vulneración a su protección y puede tener como consecuencia una sanción jurídica.
Derechos ARCO. Estos derechos consisten en lo siguiente:
1.Acceso.-Implica conocer en todo momento sus datos personales en posesión del IAEN, A. C., así como, el Aviso de privacidad correspondiente.
2.Rectificación.-Si alguno de sus datos es inexacto o incompleto, podrá solicitar su modificación, a nuestra área jurídica a través del número telefónico 656172 1645, o bien del correo eletrónico privacidad@formateycrece.com adjuntando la documentación que acredite dicha corrección.
3.Cancelación.-Podrá requerir cuando así lo considere la cancelación de sus datos y, en caso de ser procedente, su información personal entrará en un periodo de bloqueo para proceder posteriormente a su eliminación. Al entrar a dicho periodo, su información ya no podrá ser tratada por el IAEN, A. C..
4.Oposición.-Podrá en todo momento y por causa legítima objetar el tratamiento de sus datos personales. Si su solicitud resulta procedente, el IAEN, A. C. ya no podrá hacer uso de los mismos.
